User Agreement

Welcome to AirHug ("the App," "our Service"), a community application developed and operated by BOLANGX LLC ("the Company," "we," "us," or "our").

This Terms of Service Agreement ("Agreement" or "Terms") governs your access to and use of our application, website, and any related services. By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you may not access or use our Service.

1. Account Registration and Security

Eligibility: You must be at least 13 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.
Account Creation: You must register an account to access the full features of the application. You agree to provide truthful, accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.
Account Responsibility: You are solely responsible for all activities that occur under your account. You agree to maintain the confidentiality of your account credentials (username and password) and to not share them with any third party. You must notify us immediately at connect@bolangx.com upon becoming aware of any breach of security or unauthorized use of your account.

2. Acceptable Use and Community Guidelines

You agree to use the Service in a manner that is lawful, respectful, and consistent with the intended community purpose. You agree not to:

Post, upload, or share any content that is illegal, fraudulent, defamatory, libelous, obscene, hateful, harassing, threatening, discriminatory, or otherwise objectionable.
Violate, or encourage others to violate, the rights of third parties, including intellectual property rights (e.g., copyright, trademark).
Engage in unauthorized commercial activities, including advertising, promotions, spam, or any form of solicitation.
Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
Use the Service for any purpose other than its intended use, including any activity that could damage, disable, overburden, or impair our servers or networks.

3. User-Generated Content (UGC)

Your Content: You are solely responsible for the content you post, upload, share, or otherwise make available on the Service, including text, photos, videos, and music ("User-Generated Content" or "UGC"). You represent and warrant that you own or have the necessary rights and permissions to use and authorize us to use your UGC as described in these Terms.
License to Us: By posting UGC, you grant BOLANGX LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, display, reproduce, modify, adapt, publish, and distribute your UGC in connection with operating, developing, providing, and improving the Service. This license is for the limited purpose of making the Service available to you and other users.
Content Moderation: We do not pre-screen all UGC but reserve the right to review, remove, edit, or hide any content that, in our sole judgment, violates these Terms or is otherwise objectionable, without prior notice. We are not responsible for any failure or delay in removing such content.

4. Intellectual Property

Our Intellectual Property: The Service and its entire contents, features, and functionality (including but not limited to all software, text, graphics, logos, and images) are owned by BOLANGX LLC, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.
Limited License to You: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms.

5. Privacy

Our collection, use, and sharing of your personal information are governed by our Privacy Policy, which is an integral part of this Agreement. By using the Service, you consent to the data practices described therein.

6. Termination

Termination by Us: We may, in our sole discretion, terminate or suspend your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, a breach of these Terms.
Termination by You: You may terminate your account at any time by using the in-app account deletion feature or by contacting us.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data. Provisions of this Agreement that, by their nature, should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Disclaimers and Limitation of Liability

Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOLANGX LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICE; (B) THE CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

8. Indemnification

You agree to defend, indemnify, and hold harmless BOLANGX LLC and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Colorado, without regard to its conflict of law provisions. For any dispute, you agree to first contact us at connect@bolangx.com and attempt to resolve the dispute with us informally. If the dispute is not resolved informally, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.

10. General Provisions

Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and BOLANGX LLC regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck, and the remaining provisions will be enforced.
